1. Introduction

These Terms of Service ("Terms") govern your access to and use of the website located at cloudon-one.com (the "Website") and all products, software, tools, documentation, and services offered by CloudOn ("we", "us", "our"), including but not limited to:

  • CloudOn Landing Zone — multi-environment AWS/GCP infrastructure with networking, IAM, security, and best-practice guardrails powered by Terraform/Terragrunt.
  • CloudOn CI/CD Pipeline — turnkey pipeline integrating pre-commit checks, cost analysis, policy enforcement, and security scanning.
  • CloudOn Kubernetes Platform — preconfigured Kubernetes environment with IaC, service mesh, observability, and production-grade defaults.
  • CloudOn FinOps Tools — cost optimization and resource management utilities for multi-cloud environments.
  • CloudOn SecOps Tools — infrastructure validation and security checking utilities.

(collectively, the "Products")

By accessing the Website or using any Products, you agree to be bound by these Terms. If you do not agree, do not use the Website or Products.

2. Open Source Licensing

All CloudOn Products are released under the MIT License. The full text of the MIT License is reproduced below and is also available in the LICENSE file in each Product repository.

3. Website Use

While the Products themselves are MIT-licensed, the Website content — including but not limited to text, graphics, logos, trademarks, page layouts, and original documentation — remains the intellectual property of CloudOn unless otherwise stated. You may not reproduce, distribute, or create derivative works from Website content (other than Product source code and documentation covered by the MIT License) without our prior written consent.

4. Professional Services

CloudOn may offer consulting, implementation, managed services, or training ("Professional Services") under separate agreements. These Terms do not govern Professional Services; any such engagement will be subject to a separate Statement of Work or service agreement executed between the parties.

5. User Accounts

Certain areas of the Website or related platforms may require registration. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Acceptable Use

You agree not to use the Website or Products to:

  • Violate any applicable law or regulation.
  • Transmit malicious code, viruses, or any material that is harmful or destructive.
  • Attempt to gain unauthorized access to any systems, networks, or data.
  • Engage in any activity that disrupts or interferes with the Website or its infrastructure.
  • Misrepresent your identity or affiliation with any person or entity.

7. Third-Party Dependencies

The Products may incorporate or depend on third-party open source components, each governed by its own license. A list of such dependencies and their respective licenses is maintained in each Product repository. Your use of those components is subject to their respective license terms.

8. Disclaimer of Warranties

THE WEBSITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, CloudOn disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

CloudOn does not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CLOUDON, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE WEBSITE OR PRODUCTS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF CLOUDON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of certain damages, CloudOn's liability shall be limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless CloudOn and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Website or Products; (b) your violation of these Terms; or (c) your violation of any third-party rights.

11. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Website, you consent to the practices described therein.

12. Modifications to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Website or Products after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising from or relating to these Terms shall be resolved through good-faith negotiation between the parties. If negotiation fails, the parties agree to submit the dispute to the competent courts of the jurisdiction in which CloudOn operates.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

15. Entire Agreement

These Terms, together with the MIT License applicable to the Products and any separate agreements for Professional Services, constitute the entire agreement between you and CloudOn regarding the subject matter hereof.
